- ★ ☆ ☆ ☆ ☆February 16, 2020, by Deborah JohnsonI'm a widow who hired Ms. Leslie Hart-Davidson and her company Hart-Davidson Designs to oversee a 6 to 8 week project. I initially asked her to refer me to a builder and architect but she assured me she would just put everything on one contract and negotiate great bids for me. She assured me she had lowered her usual bid and was charging me a $3,000 flat fee for the life of the contract. She promised my budget was sufficient for my project but once she took my retainer money my design choices were no longer within budget and I was told I could only afford cheap finishes that did not compliment the plan nor provide the low maintenance I needed. She rarely came to the job site, I had to remind her to communicate and when the wrong roof was installed I was fed up and trying to figure out how to tell her to keep the $3,000 but go away. THEN, I discovered she had added about $13,900 to the bids that she had sworn were the actual bids of the contractor and architect. I asked her to call me but she ceased communication and eventually sued ME!! After a year of litigation (Judge Richard D. Wells, District Court, Clinton County Michigan) the ruling was handed down on 12-3-14. I prevailed and the ruling reads "The Court finds there was fraud or deception, on the part of HDD, in the inducement for this contract. Further, the Court finds that fraud or deception to have been perpetrated by Leslie Hart-Davidson in her representation of HDD." "Johnson (that's me) was clearly led to believe that HDD was performing all the needed services in this agreement for the sum of $3,000; when in reality, HDD was making many thousands more than that." "This Court finds the testimony of Leslie Hart-Davidson to be less than credible". Her suit against me was dismissed in part because "it is quite clear that HDD needed to be licensed for building maintenance and alteration contractor" and my counter-claim of fraud in the inducement was granted. She testified during the trial that she usually adds 40% to the bids and all materials but ALSO charges a 10% (or more) project management fee that she tells her clients is a flat fee that's her payment for the life of the contract. Working with her and her company was a complete nightmare for me.
